he promised to me that he will stop hacking for good. he has evaded many times anyways. we will see in uid2 if he can evade that but to me. its better to have a player that stopped hacking then to have one that hacks.

I don't trust him. I already had a serious talk with him and he promised me he'll stop but continued it the same day. How do we know he will fulfill his promise? These type of players don't deserve to play in the server who have 0 respect for server rules and admin staff. I says negotiating with him is useless.

Mate I'm not really sure what type of threat you're giving to me, but I'll let you know I don't care 1%, you are just a low hacker and your threats don't scare me. You've broken so many rules which include hacking (ofc), ban evading (ofc), insulting/abusing admins, death evading, etc. You have not given a proper apology as of now. I had a serious talk with you before and you promised me and broke the trust I had on you and therefore I don't trust you anymore. Do you think you can break so many rules and then come to us and say that I won't ban evade if you don't ban me? You expect that we forget all the past rule breaks and broken promises? I'm one of the kindest and most forgiving admin here, but you've exceeded my limits. I'm the first one to ban you for hacking and reported to other admins, and I am the first admin to unban you because you promised me, but now I don't have any trust in you. Soon the new patch will come, good luck in finding a way to evade then.

1. we keep banning him.
result: he will ban evade and start hacking.

2. we dont ban him and he never hacks again.

result: no more problems.

3. we dont ban him and he hacks again

result: he will continue to ban evade and start hacking again.

whatever we do we cant get rid of him until the ban system is upgraded.

Yes we can see a clear example of him abusing/insulting admins and it's another reason why he shouldn't be shouldn't be unbanned.
