According to rules, a person is to be punished for death evade if he is IN COMBAT. According to the proof, the person is not in combat, you need to show that.

However he did  a death evade, i killed him afterwards, but i stopped recording at that time.

We dont see any evade in a given videos so you cant give him a punishment, try to record hos evades next time.
